A Seoul district court refused to issue an arrest warrant for singer and TV personality Shin Jung-hwan for his alleged "illegal" gambling overseas.
The decision came about 10 hours after Sin was questioned by a judge who was entitled to determine whether to issue an arrest warrant for the entertainer.
Judge Kim Hwan-soo of the Seoul Central District Court said there was little possibility of Sin running away and he was unlikely to destroy evidence.
"Given the evidence, Sin is believed to have committed a crime. But he should regularly receive post-surgery rehabilitation treatment. And he is not able to destroy relevant evidence", Kim said.
Sin is suspected of having bet more than 200 million won ($180,000) in gambling at casinos in Cebu between August and September last year and using his passport as collateral.
He returned to Seoul in mid-January after nearly five months hiding overseas to avoid police questioning over the sources of money for the gambling.
