There is still criticism of the incident and netizens are curious as to why the investigation continues after he came to a mutual agreement with the woman.

SM claimed he was at a DJ party where he became intoxicated and unintentionally touched her. The woman claimed to understand the explannation and cancelled the charges.
However, Onew is still being questioned by police. This is due to the laws passed by the National Assembly on the 19th of June, 2013 that requires all sex offenders be subject to criminal penalties.
In the past, most victims who were sexually assaulted or raped were often unwilling to make reports as they were worried about second-hand damages. Also, in cases where the assailant and the victim were close to each other, such as a relatives or co-workers, victims were practically forced to cancel charges and come to an agreement, leaving the assailants unpunished.
For this reason, the women's community has been continuously urging the abolition of the crime of misdemeanor and anti-infidelity, and the National Assembly accepted and passed the relevant laws.
The more stringent laws and expectations have resulted in a more rigorous investigation of Onew's circumstances.
